New Practice Direction for HMCTS' Digital Divorce Pilot Scheme

PRACTICE DIRECTION 36E - PILOT SCHEME: PROCEDURE FOR ONLINE FILING OF APPLICATIONS IN CERTAIN PROCEEDINGS FOR A MATRIMONIAL ORDER

We can reveal that the correct and full version of the Family Procedure Rules Practice Direction 36E, first published on 16 January was updated and published in full today, 22 January 2018. (See Justice link above)

Although it is yet to be confirmed in detail by HMCTS, this heralds the next phase of its online divorce pilot project, "Apply for Divorce". HMCTS tell me that it will issue a press release shortly.

In the meantime, it has said the following:

"New Practice Direction 36E extends the next stage of the pilot for the Online Divorce Service, which will allow divorce applications to be completed and submitted online. This supersedes the current pilot Practice Direction (PD36D) which allows for applications to be generated online, then printed and posted to the court".
